The Law Offices of Mary K. Kelly spans New York State, serving clients in Nassau, Suffolk, Queens, Kings and Monroe Counties.  Offering a wide array of legal services, our mission is to counsel you with regard to your legal rights and when necessary, to be your advocate, protecting your rights.  We can help you meet your personal goals with the following issues:

Estate Planning / Elder Care Law - Estate planning is the set-up and administration of your estate to ensure that your desired beneficiaries are provided for. You use a will or trust to name your beneficiaries and expedite the settlement of your estate when you die. Estate planning has significant tax consequences; the maximum estate tax rate is 47%. This can be avoided with proper planning.  Further, Elder Care Laws and planning can protect assets in the event of illness requiring long term nursing home care.

Medicare and Medicaid Planning - Medicare Part A covers up to 100 days of "skilled nursing" care per spell of illness.  That's it!  For all practical purposes, in the United States the only "insurance" plan for long-term institutional care is Medicaid.  If you are concerned about long term care costs and how to plan to protect your assets in the event of catastrophic illness, call us.  We have successful asset saving strategies for your consideration!

Personal Injury - Plaintiff - Our firm represents individuals involved in controversies alleging a wrong or damage to another’s person, rights, reputation, or property resulting from events or activities such as automobile accidents, defective products, infliction of emotional distress, intentional misconduct, and negligence.

Business Organizations - The form of business chosen for a business entity potentially affects every aspect of its operations.  Our firm assists our clients in formation and business planning in deciding whether they want to operate as a closely held business, limited liability company, partnership, or corporation.  We advise our clients about directors’ and officers’ liability, dissolution, franchising, reorganization, trade association membership and activity, joint ventures, mergers, acquisitions, divestitures, business successions, and shareholders’ rights.  Our attorneys have many years of combined experience in handling both transactional and litigation matters.

Family Law - Our firm handles a full range of Family Law matters including adoption, divorce, separation, premarital agreements, paternity, custody, and support.

Probate & Estate Administration - Probate is the court proceeding through which a will is proved to be valid and the property of the deceased is administered. The process includes collecting the deceased's assets, paying their bills, paying necessary taxes, and distribution of property to their heirs.  The Law Offices of Mary K. Kelly will help you plan your estate or administer the estate of a deceased family member.

Estate Planning - We are knowledgeable in estate planning , living trusts and other techniques that protect your assets and minimize estate taxes. For many years, we’ve helped clients throughout Long Island and Rochester New York plan for their future.

Taxation Law - Our firm represents individuals and commercial clients in matters with tax implications, identifying and addressing state and federal tax issues, structuring transactions in such a way as to minimize taxes and avoid inherent tax problems.

Product Liability Law - We represent individuals who have been injured as a result of an unsafe product that was designed, manufactured, sold, and/or furnished by a person or company. We assist those injured individuals in bringing their claims and being fairly compensated for their injuries from: asbestos, apparel, alcoholic beverages, firearms, food and agricultural products, machinery and tools, medical products and devices, motor vehicles, pharmaceutical products, recreational products, and tobacco.

Health & Health Care Law - Our firm has extensive experience in the large and complex body of health and healthcare law which encompasses areas such as disability law, elder law, hospital law, and mental health law and is impacted by Social Security Disability, Medicare and Medicaid, and the Food and Drug Administration.  We also have a large managed care practice, representing individual practice association clients in negotiating contracts with HMOs and in the formation of preferred provider organizations.

Landlord/Tenant - Landlord-tenant law governs the rental of commercial and residential property. The basis of the legal relationship between a landlord and tenant is grounded in both contract and property law. The tenant has a property interest in the land and the landlord seeks payment from the tenant for the use of that commercial or residential property. If you are in a dispute, whether you are a landlord or a tenant, we can help.

Real Estate Law - If you are considering the purchase or sale of residential or commercial New York area property, you need to have all of the legal issues thoroughly addressed. Such transactions involve large sums of money and can be very complex. At The Law Office of Mary K. Kelly, Esq., We have the experience it takes to consider every aspect of your Residential or Commercial real estate or business transaction.

Bankruptcy - Our firm represents individuals and commercial clients in bankruptcy proceedings, at both the state and federal level, that are initiated by either an insolvent individual, or business, or creditors seeking to have the debtor’s remaining assets distributed among the creditors and, thereby, discharging the debtor from further obligation or restructuring and reorganizing the insolvent’s debt structure.

We are a debt relief agency. We help people file for bankruptcy relief under the Bankruptcy Code.
